Are magic mushrooms legal in Oregon?
Legal / regulatedPartly. A licensed legal route to psilocybin exists in Oregon, but it does not make mushrooms legal everywhere or for everyone.
Adults 21 and over can take psilocybin at a state-licensed service centre under a licensed facilitator, after a preparation session; no prescription, referral or Oregon residency is required. Products cannot be bought or taken off-site. This is not general legalisation: since 1 September 2024 HB 4002 has made possession of small amounts of controlled substances a misdemeanor again, reversing Measure 110's decriminalisation.

What is and is not allowed
- Possession
- Psilocybin products may only be bought and consumed at a licensed service centre during an administration session and may not be taken off-site; outside that framework, possession of small amounts of controlled substances has been a misdemeanor since 1 September 2024 under HB 4002.
- Sale and supply
- Only licensed manufacturers and licensed service centres may handle and sell psilocybin products, and clients can only purchase them on-site during an administration session.
- Penalties
- HB 4002 replaced the Class E violation for small-amount possession with a misdemeanor effective 1 September 2024; the default is probation with treatment, and a probation violation or waiver can lead to up to 180 days in jail. Delivery near treatment facilities, shelters or parks carries up to 18 months.
- Recent changes
- HB 4002 recriminalised small-amount drug possession from 1 September 2024. OHA lists a 2026 Psilocybin Product Potency Workgroup, and OHA-linked news in September 2026 reported proposed licence fee increases were dropped.

Only inside the state programme: adults 21+ can take psilocybin at a licensed service centre with a licensed facilitator. Possession outside that framework is not legal, and small-amount possession has been a misdemeanor since September 2024.
Do I need a prescription or Oregon residency?
No. OHA states that no prescription or medical referral is required and clients do not need to live in Oregon, but you must be 21+ and complete a preparation session first.
Can I buy psilocybin to take home?
No. Products can only be purchased at a licensed service centre during an administration session and may not be taken off-site.
